FSSAI : An overview

FSSAI (Food Safety and Standards Authority of India) is a premier government body that underpins standards for the selling, packaging, or storage of food items in India. To ensure utmost food safety, the FSSAI has mandated every food business operator to secure an applicable food license. FSSAI functions under the aegis of the Ministry of Health and Family Welfare and the Government of India. FSSAI outlines various guidelines and standards in accordance with the Food Safety and Standards Act, 2006.

FSSAI Basic Registration generally covers the small FBOs. It is entirely distinct from the FSSAI central and state license. FSSAI Basic registration can be secured electronically by filling the FSSAI registration form on an electronic system known as Food Licensing & Registration System (FLRS).

FLRS also enables the applicant to track the submitted application during the processing stage. Almost, 35 States/Union Territories have been granted a license/registration certification electronically. The FSSAI license is usually granted for a timeframe ranging from 1-5 years. The license holder should renew their certification before thirty days of the expiration date via the FLRS portal.

It is essential to know whether the FBO needs just registration or a central/state license for its business. Typically, all small food business operators who are not doing any manufacturing or processing and having an annual turnover of less than 12 lacs and are carrying business in one state only need to seek FSSAI Registration. In contrast, the Other food business operator needs to procure a license. A detailed description of the eligibility is discussed in the eligibility section of this page.

Even NGOs involved in distribution of surplus food or Temples organizing langar or bhandara, offering prasad need FSSAI License or Registration as per their eligibility criteria.

FSSAI Licence Registration Eligibility

The eligibility criteria for FSSAI license registration in India depend on the type of license. Here are the details:

Basic FSSAI License

  • Annual turnover of the food business does not exceed ₹12 lakhs
  • New food business operator intending to sell food products in the market

State FSSAI License

  • Annual turnover of the food business exceeds ₹12 lakhs but does not exceed ₹20 crores
  • Food business operators having an annual turnover of up to ₹12 lakhs but operating in more than one state

Central FSSAI License

  • Annual turnover of the food business exceeds ₹20 crores
  • Food business operators operating in multiple states

Apart from this the following are also eligible for a food license

  • Any FBO with a maximum annual turnover of ₹12 lakh.
  • Food product retailer.
  • Someone who manufactures or sells food products on their own.
  • The person operating the makeshift stand sells food.
  • Any person, excluding a caterer, who serves meals during a religious or social event.
  • Small-scale or home-based businesses engaged in the food industry.

Procedure for applying for FSSAI Basic Registration

  • Every petty FBO shall register themselves with the Registering Authority (RA) by furnishing a registration form (Form A) under schedule 2 of these regulations along with standard fee as cited in Schedule 3.
  • The petty food manufacturer shall comply with underlying hygiene & safety norms cited in Part I of Schedule 4 of these norms & facilitate a self-attested document cum declaration of adherence to these norms with the form in the format cited in Annexure-1 under Schedule.
  • The Registering Authority (RA) shall consider the application form and may either accord registration or revoke it with concrete reasons to be recorded in written or grant notification for inspection, within seven days of receipt of a registration form.
  • In the case of an inspection being executed, the registration shall be accorded by the RA after being satisfied with the underlying conditions for safety, hygiene, and sanitary of the premises as cited in Part II of Schedule $ within the timeframe of 30 days.

If registration is not accorded or revoked, or inspection does not take place within 7 days cited in above sub-regulation (3) or no decision is communicated within 30 days timeframe as cited in the above sub-regulation (4), the business owner may commence its business undertaking, provided that it will be incumbent on the FBOs to meet any improvement directed by the RA even later.

Provided that registration shall not be refused without giving the applicant an opportunity of being heard and for reasons to be recorded in writing.

  • The Registering Authority (RA) shall accord a registration certificate & a photo identification card, which shall be displayed at a business place at all times or cart or vehicle or any other place where the individual carries the food business in case of Petty Food Business.
  • The Registering Authority (RA) or any institution authorized for this purpose shall inspect the registered business place at least once a year.

Documents Required for FSSAI Registration

Based on different types of registration and the food business that you are running, you have to submit different documents required for FSSAI Registration.

FSSAI Registration

  • Authorized person’s passport-size photograph [self-attested];
  • Authorized person’s Aadhar card front and back [self-attested];
  • Address proof of the business premises [rental agreement/previous month’s electricity bill/NOC from landlord];
  • Declaration signed by the authorized person.

State & Central License

  • Passport-sized photograph of the directors/partners/proprietor;
  • Identity proof of directors/partners/proprietor [Aadhar and PAN Card];
  • Address proof of the business premises [rental agreement/previous month’s electricity bill/NOC from landlord];
  • Photograph of the premises [8-9 photos];
  • Blueprint of the premises;
  • List of food products on the company letterhead [with seal and signature];
  • List of machines (if any) on the company’s letterhead [with seal and signature].

Manufacturing Units

Including the documents required for FoSCoS FSSAI Registration, manufacturing units have to submit the following documents as well:

  • The blueprint of warehouse, plant, etc.
  • A list of all machinery;
  • Report of a water test;
  • List of all food categories.

Penalty for Non- Compliance

Non-compliance with FSSAI regulations can result in penalties and legal action by the authorities. Here are some of the penalties for FSSAI non-compliance:

  • Penalty for selling unsafe or substandard food is up to ₹5 lakhs;
  • Penalty for misleading advertising is up to ₹10 lakhs;
  • Penalty for obstructing or failing to cooperate with FSSAI officials is up to ₹2 lakhs;
  • Penalty for violating FSSAI regulations is up to₹2 lakhs;
  • Penalty for carrying out food business without FSSAI registration or license is up to ₹5 lakhs;
  • Penalty for manufacturing or selling misbranded food is up to ₹3 lakhs;
  • Penalty for manufacturing or selling food containing extraneous matter is up to ₹1 lakh;
  • Penalty for causing injury or death due to the consumption of unsafe food: Imprisonment of up to 6 years and a fine of up to ₹5 lakhs.
