FSSAI Renewal: An overview

In India, the FSSAI registration or license is mandatory for the Food Business Operators (FBOs) before starting any food business. The Food Safety and Standards Authority of India (FSSAI) issues the FSSAI registration or license to FBOs who comply with the Food Safety and Standards (FSS) Act, 2006 and Regulations.

All the traders, manufacturers, restaurants, importers and exporters of food, food storage and transport service providers, and others involved in the food business must obtain the FSSAI registration or license number, which must be printed on food packages along with the FSSAI logo.

The FSSAI registration or license is issued with a 1 to 5 years validity period. The FBOs must apply for FSSAI registration or license renewal before its expiry to continue the food business. Thus, FSSAI registration renewal is equivalently significant to getting the FSSAI registration. The FBOs can renew the FSSAI registration/license 120 days before its expiry date.

There are three types of FSSAI registration renewal, which are as follows:

  • FSSAI Basic Registration Renewal – The FSSAI Basic Registration renewal is applicable for FBOs whose food business annual turnover is below Rs.12 lakh. They need to apply for renewal in Form A. 
  • FSSAI State License Renewal – The FSSAI State License renewal is applicable for FBOs whose food business annual turnover is more than Rs.12 lakh but below Rs.20 crore. They need to apply for renewal in Form B. 
  • FSSAI Central License Renewal – The FSSAI Central License renewal is applicable for FBOs whose food business annual turnover is more than Rs.20 crore. They need to apply for renewal in Form B. 

Process of FSSAI Renewal

An FBO can apply for FSSAI registration/license renewal either offline or online.

Offline FSSAI Registration Renewal Process

  • Visit the respective food safety officer-in-charge or designated officer and obtain Form A or Form B as per the annual turnover. 
  • The applicant must fill out Form A or Form B.
  • Attach a self-attested declaration and the required documents.
  • Submit the filled form with the applicable fees to the concerned authority.
  • After receiving the renewal application, the food authorities will verify and examine the application.
  • The food authorities may inspect the food premises to check if the FBO has disclosed and submitted the correct information.
  • When the inspection officer is satisfied with the FBOs compliance with the regulations, they will pass the inspection report to the FSSAI authorities.
  • The FSSAI authorities will issue the FSSAI registration/license renewal when they are satisfied that the applicant meets the FSS Act requirements.
  • The FSSAI authorities must issue the FSSAI license within 60 days. If the FBOs receive no response from the authorities within 60 days, they can run the business without wasting time.

Online FSSAI Registration Renewal Process

The FBOs can renew the FSSAI registration online in two ways, i.e. by logging into the FoSCoS website or through the home screen of the FoSCoS website.

The process to renew FSSAI registration/license by logging into the FoSCoS website is as follows:

  • Visit the FoSCoS website and log in using the FSSAI license or Certificate number and password.
  • After logging in, click on the ‘Renewal’ option available on the left-hand side of the screen and select the ‘Apply for Renewal of license/registration’ option.
  • A list of issued FSSAI licenses or registration will appear on the screen. Click on the ‘Proceed’ button for the license or registration that requires renewal. The FSSAI license/ registration eligible for renewal will be displayed only 120 days before its expiration.
  • Form A or Form B will open where the FBOs can edit only the details that are editable. On the form, certain details are editable, and certain details are non-editable. 
  • Upload the required documents and pay the applicable renewal fees.
  • After paying the fees, a receipt is generated with a new 17-digit registration number.
  • The FBOs can track the renewal application status on the FoSCoS website by entering the new 17-digit registration number.
  • The process to renew FSSAI registration/license through the home page of the FoSCoS website is as follows:
  • Visit the FoSCoS website and click on the ‘Renewals Fee is same as of new license and registration’ tab.
  • Enter the ‘license/registration No.’, ‘Validity End Date’, ‘Captcha’, and click on the ‘Submit’ button.
  • The license/registration details page will be displayed. Click on the ‘Proceed’ button.
  • Form A or Form B will open where the applicant should upload the documents, select the years for which license is required, choose the payment method, and click on the ‘Save & Next’ button.
  • After completing the payment, a receipt is generated with a 17- digit reference number.
  • The FBOs can track the renewal application status on the FoSCoS website by entering the 17-digit registration number. The FSSAI Basic Registration is usually renewed within seven working days. The FSSAI State License and Central License will take 30 days to be renewed. However, FBOs can continue their food businesses with the existing registration or license number if they have applied for renewal. 

Documents Required for FSSAI Registration Renewal

The documents required to be submitted for FSSAI Basic Registration are as follows:

  • Address proof of the business (Electricity, phone, or gas bill).
  • Identity proof of the FBO, such as Pan card, Voter ID, driving license, Aadhaar card, Passport, etc.
  • Two passport size photos of the applicant.
  • NOC by the municipality or panchayat, health department, etc.
  • Rent agreement and NOC from the owner, if the business premises is rented.

The documents required to be submitted for FSSAI State and Central License are as follows:

  • Identity and address proof of the applicant.
  • Layout plan of the food processing plant.
  • List of directors or partners with their full address, in the case of company or partnership firm.
  • ID and address proof of the directors or partners or authorized signatories, in the case of company or partnership firm.
  • Partnership deed or Memorandum and Articles of Association, in the case of partnership firm or company.
  • List of food categories (for manufacturers).
  • Rental agreement and NOC from the landlord, if the business premises is situated on rented land.
  • NOC from the municipality or any other local body.
  • Name and number of equipment according to the installed capacity and horsepower for processing and manufacturing units.
  • Nomination of persons by a company with the passed board resolution in Form IX.
  • Certificate from the Ministry of Commerce for 100% EOU, in the case of Central License.
  • IEC registration issued by DGFT, in the case of Central License.
  • Analysis report of water to be used in the food, in the case of Central License
  • A cancelled cheque.

Additional documents required for manufacturing and processing units are as follows:

  • Layout plan of the premises showing the operation and dimension wise area of the unit.
  • List of equipment and machinery with their horsepower and number and the installed capacity of the machinery.
  • The entire list of food categories desired to be manufactured by the unit.
  • The report of analysis of the water used in the food from a recognized public health laboratory.
  • Letter of authority with the name and address of the responsible person nominated by the manufacturer.

Fees for FSSAI Registration Renewal

The FSSAI license or registration renewal fees are the same as obtaining a new license or registration. The license or registration fee varies depending on the food business’s annual turnover and manufacturing capacity. It ranges from Rs.100 to Rs.7500 per year.

Consequences of Non Renewal of FSSAI Registration/License

The FBOs must apply for FSSAI registration/license renewal before 120 days of the expiry of the registration/license. The FSSAI registration/license renewal process starts 120 days prior to its expiry. However, FBOs must apply for renewal within 120 to 90 days before the FSSAI registration/license expires.

When the FBOs apply for renewal of the FSSAI registration/license within 90 days prior to its expiration, Rs.100 is charged for each day of delay. When the renewal application is applied between 90 days of its expiry but before its expiry date, the FBOs must pay a fine of Rs.100 per in addition to renewal fees. Thus, to avoid a penalty of Rs.100 per day, the FBOs must apply for renewal of the FSSAI registration between 120 to 90 days prior to its expiry. 

When the FBOs do not apply for the FSSAI registration/license renewal before its expiry, the registration/license will expire. The FBO has to apply for a new registration/license to stay or restart their business in such a case. Therefore, it is advisable to renew the FSSAI registration/license on time to evade penalties or apply for a new one.
